A BILL to amend article two, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section thirty-nine, relating to salaries of public employees.

Be it enacted by the Legislature of West Virginia:

That article two, chapter five-a of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section thirty-nine, to read as follows:
ARTICLE 2. FINANCE DIVISION.

§ 5A-2-39. Salary limits of state and county government employees; not to be in excess of top elected officials.

No appointed or hired state government or county government employee may receive an annual salary in excess of the average annual salary of the top elected officials of this state. The term top elected officials includes the governor, members of the board of public works and justices of the West Virginia Supreme Court of Appeals: Provided, That this section does not apply to salaries of those persons employed in education.




NOTE: The purpose of this bill is to ensure that no state or county government employee will receive an annual salary in excess of the annual salary of the top elected officials of this state.
